Dr. Alan Cusack, in collaboration with Alex Ruck-Keene QC and Allegra Enefer, has contributed a chapter to a highly acclaimed new edited collection, Mental Capacity Law, Sexual Relationships, and Intimacy (2024, Bristol: Bristol University Press), edited by Beverley Clough (Manchester Metropolitan University) and Laura Pritchard-Jones (Keele University).
Drawing on the recent Supreme Court (UK) decision in A Local Authority v JB [2021] UKSC 52, the chapter explores the clash of principles that can arise between the need for sexual consent to be true consent, and the need to support the exercise of sexual expression by those with cognitive impairments.
