The research of Dr Laura Cahillane on the origins of the Constitution was cited by the Supreme Court on Monday in a significant judgment by Mr Justice Hogan on the right to inviolability of the dwelling. The case, which is being regarded as a victory for Travellers' rights, considered whether Clare County Council could order a family to vacate land occupied illegally. Mr Justice Hogan referred to the work of Dr Cahillane in relation to the meaning of Article 40.5 and the interpretation of this provision was a key aspect of this landmark judgment.
