Maternity Leave

Since 3 July 2023, maternity leave is available to transgender men who are pregnant or have given birth. You must have a gender recognition certificate, in accordance with the Gender Recognition Act 2015.

These new rights are set out in the Work Life Balance and Miscellaneous Provisions Act 2023.

Parent’s leave is unpaid. However, dependant on your PRSI status, there may be an entitlement to claim Parent’s Benefit for this 7-week period from the Dept. of Social Protection.
